1)Lots are sold from Boetto Auction open to public; it acts as mandatary, it is commissioned with the sale of the objects entrusted to it, in the name and on behalf of the commissioners. The seller’s name is written in the P.S. records at B.A.

B.A. declines any responsibility other than mandatary liabilities.

2)Items are given to the best bid in cash; if contrasting offers arise,the item in question could be newly auctioned within same bidding, decision taken by the Auctioner. Whilst the offering, the bidder has the responsibility to pay the decided price, include auction fees, taxes and any other expense.

3) B.A. has the right to with hold from the A. any lot. The Auctioner, during the Auction, can match or divide lots and also change selling sequence. The former could cancel lots from Auction if offers don’t reach demanded price between A.B. and seller.

4) The purchaser shall pay an auction fee, for each lot, equivalent to 22% of the hammer price, inclusive of VAT and taxes  Auction Right are added to final price. On goods highlighted by “*”, coming from entrepreneurs who are not under particular fiscal laws, must pay the Auction right of 22% plus VAT;

Sale is under Vat on final price, except other expenses.

5) the Manager sale can accept sale items commissions on precise price by mandate and can decide to offer in the name of the seller

6) A.B. can be accept purchase mandaties (written and telephone offers), increasing  by auctioner, contending with other Auction participants; A.B. cannot be held responsible for any errors which may emerge in its management of written or telephonic offers.

7) In the event of receipt  two identical written offers for the same lot, precedence will be given to that received first.  A.B. can refuse unknown purchasers, if not depositing for the whole value of lots, or if not offer other guarantee. At hammer price, A.B. can ask personal data to the purchaser , and if not paying immediately in cash, he must give verifiable bank guarantees: if not complete, false or inadequate data, A.B. has the right to cancel sale.

8) A.B. is seller’s mandatary and declines any responsibility on catalogue, brochure or other types of auction objects descriptions; Descriptions are purely indicative. Before the auction there will be a viewing, to value the  authenticity , condition, origin and type and quality of the objects. After the auction, neither A.B. not seller are liable for flawing in preservation condition, assignment, authenticity, origin, weigh and quality of the objects. Neither A.B. nor charge Boetto staff can guarantee for that, excluding legal cases.

9) base prices are printed under lots description in the catalogue and not include Auction rights. Esteems are in advance and can be change. Also catalogue description can be change during the Auction.

10) Complete payment of the hammer price of the auction rights may be immediately exacted by A.B ; payment must anyway be made no later than 7 days after the auction.

Lots purchased and paid for must be collected immediately by purchaser, at one's own expense and risk with own staff and within 7 days. Otherwise, A.B. shall be entitled to all storage rights, while being exonerated from all liability in relation to such storage and to the eventual deterioration of the objects. The dayly cost of such storage is Euros 5,00 for furniture and euros 2,50 for other objects.

For exworks sales, not collected objects carry to our warehouse. Trasporting costs charged to seller.On seller request and on his responsibility,  A.B. thinks about packing, transport of lots.

11)if no payment , A.B. can:

a) return the objects to seller and demand to purchaser lost commissions;

b) demand for forced execution of the purchase;

c)sell the lot with private treaty, or in the next auctions, keeping deposit.

 12) A.B. has the right to decide with purchasers special type of payment, deposit, private sale for not keeping lots, insurance for hammer lots, solving contrasts against or by purchasers and other actions for gaining price.

13) Sellers must enforce any laws for objects declared important on the basis of art.6 of D.Lgs. 29th of October 1999,n.490,and in particular to the articles n.54 and next. The export of subjects by seller  resident in Italy or foreigns  is regaled by the same Law and by the custom, tributary and currency enforced laws. Exporting permission costs euros 200,00. Time of wait is 45 days after request to the cultural Department, export office. Licence request is sent to the department after payment of the lot and after the authorization written by the purchaser. A.B. declines any responsibility on Italian restriction about transport or license. In case The State preempt  the objects, the purchaser can’t ask for any A.B. or seller commissions or interests repay .

14)in the event of contrasts on false objects accepted by A.B., if the communication is send to A.B. within 21 days before the sale, A.B. could cancel the sale and reveal to purchaser the name of the seller, Warned.

15) All information about punch of metals, carats and weight of gold, of diamonds and colours  of precious stones are only indicative and A.B. declines any responsibility for mistakes in the information and falsification. Some weight was determinated with measurement . these informations are indicative.

16) added at this terms, if A.B. discovering hat some lot belong  to people different from the seller, could keep goods for all period of contrast or for all period that A.B. thinks is necessary.

17) These Conditions of Sale are automatically accepted by those participating at the auction. In the event of any dispute whatsoever, the Court of Genoa is held to be competent.
